A 30-year-old man, Nureni Musa has been arraigned before the Osogbo Magistrate court, Osun State over alleged threat to life of one Pastor Johnson Faronbi and his siblings.
The defendant was dragged to court on Monday on a five-count charge edging on forceful entry, unlawful damage, breach of peace and threat to life.
Police prosecutor, Inspector Lamidi Rasaki told the court that the defendant forcecfully entered the landed farm property belonging to Faronbi’s family represented by their children Pastor Johnson, Mrs Victoria, Mrs Adebayo Faronbi, and others.
Rasaki said the defendant threatened Faronbi’s family with dangerous weapons, i.e cutlass and charms right after he unlawfully damage Kolanut and other Ecnomical trees valued yet unknown on the aforementioned land.
According to the police prosecutor, the accused offences is in contrary to section 2 (1&2) and purnishable under sections 3&4 of State of Osun forceful entry and illegal occupation of landed properties (prohibition) laws of Osun State of Nigeria 2019.
Stressing further, he said the defendant alleged offences are also punishable under sections 451, 86 and 133 (9) of the criminal code cap 34 vol. II Laws of Osun State of Nigeria 2002 respectively.
He did, however, enter a not guilty plea to the five count allegations.
The defense counsel, Omotayo Adebowale, then pleaded with the court to grant client bail, pointing out that he will be available for his trial.
However, the police prosecutor objecting his bail pointed out that the defendant might jump bail because he refused to return to the police after receiving administrative bail before he finally nabbed in Iragbiji.
Thereon, Omotayo stood his ground, arguing that the court’s rejection to grant bail to his defendant will amount to disregarding the intent of the constitution and that the case in question was not one of murder.
After much commotion, the presiding magistrate Olusegun Ayilara approved the defendant’s bail with a sum of one million naira and two sureties in like some.
The case was postponed by Ayilara to October 3rd, 2022 for mention.
