The Federal High Court in Abuja has dismissed a suit filed by MultiChoice Nigeria Limited aimed at preventing the Federal Competition and Consumer Protection Commission (FCCPC) from taking administrative action against the company.
In his judgment on Thursday, Justice James Omotosho ruled that the suit constituted an abuse of court process.
According to the News Agency of Nigeria (NAN), MultiChoice—the operator of DStv and GOtv—had recently increased subscription rates for its packages, prompting the FCCPC to invite the company to explain the price hike.
Previously, Justice Omotosho had issued an interim order restraining the FCCPC from taking any administrative steps against MultiChoice following the announcement of the new tariffs.
The order was granted after MultiChoice’s counsel, Moyosore Onigbanjo, SAN, argued that despite ongoing litigation, the FCCPC continued to send letters threatening further sanctions against the company.
The case, marked FHC/ABJ/CS/379/2025, has now been dismissed, clearing the way for the FCCPC to proceed with its administrative measures against MultiChoice.
