Prince Lukman Gbadegesin, a leading contender for the Alaafin of Oyo throne, has taken legal action to challenge the Oyo State Government’s proclamation of Prince Akeem Abimbola Owoade as the new Alaafin.
In a lawsuit filed at the Oyo State High Court on February 12, Gbadegesin is seeking the court’s intervention to nullify Owoade’s appointment, arguing that it violates the Chiefs Law of Oyo State, 2000, and the Registered Alaafin Chieftaincy Declaration of 1961. He is also requesting an injunction to prevent Owoade from assuming the throne or performing any royal functions.
The suit lists Governor ‘Seyi Makinde, the Attorney General of Oyo State, and 11 others as defendants, compelling them to appear in court within 30 days.
Filed through his counsel, Kunle Sobaloju (SAN), Gbadegesin contends that the governor’s approval of Owoade’s appointment within five days of its presentation was unlawful, unconstitutional, and invalid. He insists that he was the rightful candidate, having been selected by the kingmakers (Oyomesi), and demands a court declaration affirming his nomination.
He further argues that Governor Makinde’s decision to approve Owoade’s appointment disregarded due process and excluded legitimate kingmakers who had neither been suspended nor removed.
Gbadegesin is also seeking a court order directing the governor to recognize and approve his appointment as the legitimate nominee of the Agunloye Ruling House, as selected by the kingmakers.
Additionally, he requests an injunction restraining the government and other relevant authorities from recognizing Owoade as Alaafin, preventing the payment of any allowances, salaries, or privileges associated with the position. He further demands the annulment of Owoade’s nomination, selection, and appointment, arguing that it was carried out in violation of established legal provisions and is therefore null and void.
This lawsuit follows a pre-action notice served to Governor Makinde, asserting that his actions contravene the Oyo State Chiefs Law.
Meanwhile, the Oyo State Government and Oba Akeem Abimbola Owoade have recently formed committees to oversee the planned coronation ceremony set for April 5.
